Terms & Conditions

These Terms & Conditions (the "Terms") govern your use of pergolamod.com (the "Website") and every order placed through it. The Website and store are operated by Dream Sunrooms LLC, 4124 Walney Road #H, Chantilly, VA 20151 ("PergolaMod", "we", "us", "our"). Please read these Terms carefully before ordering — by using the Website or placing an order you accept them. If you do not agree with them, please do not use the Website.

Definitions

"Products" — the aluminum louvered pergolas, carports, side screens, sliding shutters, heaters, LED kits and other goods offered on the Website.
"Standard Products" — Products in the catalog sizes and colors listed on the Website.
"Custom Products" — Products made or configured to dimensions or specifications agreed individually with you, including custom pergola quotes.
"Order Confirmation" — our email confirming acceptance of your order.

Products and specifications

Product specifications, dimensions, load ratings, colors and illustrations are provided in good faith based on manufacturer data. Minor deviations in color, finish and construction that do not affect function may occur between product images and delivered goods; screen rendering of colors (such as RAL 7016 anthracite and RAL 9010 white) also varies by display. Dimensions expressed in feet (for example 10' × 13') are commercial size designations for metric manufacturing sizes; exact technical dimensions are stated in the product documentation and installation guides. Wind-resistance and snow-load ratings are engineering values that apply only to products assembled and anchored according to the supplied instructions.

Ordering and contract formation

Displaying Products on the Website is an invitation to purchase, not a binding offer. When you place an order you make an offer to buy. A contract is formed only when we send you an Order Confirmation. We may decline or cancel an order before delivery where there is an obvious pricing or listing error, suspected fraud or misuse, or where a Product is unavailable; in that case we will notify you and refund any amounts already paid in full. Please check your Order Confirmation carefully — especially sizes, colors and mounting type — and contact us immediately if anything is wrong.

Prices and payment

All prices are stated in US dollars. Prices do not include any applicable sales tax unless shown at checkout, where the final amount including tax and any delivery charge is displayed before you confirm the order. Prices, promotions and discounts may change at any time without notice; the price applicable to your order is the price at the time the order is placed. Payment is due in full at the time of ordering unless we have agreed different terms in writing (for example for custom projects, where a deposit schedule may be agreed). We may withhold delivery until payment has been received in full.

Delivery

Delivery takes place as described in our Shipping & Returns policy, which forms part of these Terms. Stated lead times are careful estimates and not guaranteed dates; delay does not entitle you to damages where we have exercised reasonable care. You are responsible for ensuring the delivery address is correct and accessible for freight delivery and that someone is available to receive and inspect the shipment.

Risk and title

Risk in the Products passes to you upon delivery. Title passes when we have received payment in full. Until then, you may not resell, install into real property in a manner preventing removal, or otherwise dispose of the Products.

Assembly, anchoring and use

Our Products are engineered systems supplied for assembly according to the included instructions. You are responsible for:

Providing a suitable, level and load-bearing base (concrete foundation, solid stone terrace or structural deck) and, for wall-mounted versions, a structurally sound facade;
Assembling and anchoring the Product exactly as described in the instructions, or having it assembled by competent professionals;
Having any electrical connection (230 V motor and LED supply where applicable per specification, or the equivalent supply stated in the product documentation) made by a licensed electrician;
Operating the Product within its published ratings — including setting the roof louvers to the open position during heavy snowfall as described in the documentation;
Obtaining any permit or homeowners-association approval required for your property. Permit requirements are your responsibility; our permit guide is general information, not legal advice.

Warranty

We provide the following limited warranty from the date of delivery: 5 years on the aluminum structure (frame, posts, louvers) against material and manufacturing defects, and 2 years on roof mechanisms, crank systems, motors and electronic components. Within the warranty period we will, at our option, repair the Product, supply replacement components, or replace the Product.

The warranty does not cover:

Damage caused by assembly or anchoring not in accordance with the instructions;
Damage from use outside the published ratings, including snow accumulation on a closed roof beyond the rated load;
Normal wear, cosmetic aging, and minor color changes from weathering;
Damage from modifications, third-party parts, neglect, or improper cleaning (e.g. aggressive chemicals or pressure-washing seals);
Damage from extraordinary events such as floods, falling objects, fire or vandalism.

Warranty claims should be sent to sales@pergolamod.com with your order number, a description and photos. This warranty is in addition to, and does not limit, any rights you have under applicable consumer law.

Returns and cancellations

Returns, damage claims and cancellations are governed by our Shipping & Returns policy, which forms part of these Terms. In summary: transport damage must be noted on the carrier's delivery receipt and reported within 48 hours; unopened Standard Products may be returned within 14 days with prior authorization, with return freight and a 15% restocking fee borne by the customer; Custom Products are non-returnable.

Limitation of liability

Nothing in these Terms limits liability that cannot be limited by law, including for gross negligence or willful misconduct. Subject to that, our total aggregate liability for any claim arising out of or in connection with an order is limited to the amount you paid for the Products concerned, and we are not liable for indirect, incidental, special or consequential damages — including lost profits, loss of use, or damage to landscaping, surfaces or other property arising from installation not performed according to the instructions. Where Products are installed by third parties you engaged, the installer is responsible for the workmanship of the installation.

Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, extreme weather, epidemics, labor disputes, transport disruption, energy shortages, and acts of authorities. If such an event continues for more than 90 days, either party may cancel the affected order, in which case we will refund payments for undelivered Products.

Intellectual property

All content on the Website — text, product descriptions, guides, photographs, renders, graphics, logos and design — is the property of Dream Sunrooms LLC or its licensors and is protected by copyright and trademark law. You may not reproduce, distribute or use it commercially without our prior written consent. You are welcome to share links to our pages.

Indemnification

You agree to indemnify and hold us harmless from claims by third parties arising out of your breach of these Terms, your violation of law, or installation and use of Products contrary to the supplied documentation.

Governing law and disputes

These Terms and every order are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Disputes shall be brought in the state or federal courts located in Fairfax County, Virginia, unless mandatory consumer law gives you the right to another venue. Before starting formal proceedings, we ask that you contact us first — nearly every issue can be resolved directly and quickly.

Miscellaneous

Severability — if any provision of these Terms is held invalid, the remaining provisions remain in full force.
No waiver — our not enforcing a provision is not a waiver of it.
Assignment — you may not transfer your rights under an order without our consent; we may assign to an affiliate or successor.
Entire agreement — these Terms, the Order Confirmation and the policies referenced in them are the entire agreement for your purchase.
Changes — we may update these Terms from time to time; the version in force when you place an order applies to that order.
